It is better to prefer a public defender program for those who are on trials and those who cannot afford to pay for it.

A public defenderis an attorney-at-law     who are appointed by the courts, paid and provided by the federal or state governments to represent and advise those who cannot afford to hire a private attorney.

Free legal aid is the right of every citizen those who cannot afford to legal procedures. And since a trial cannot be completed without proper legal procedures, A public defender program is preferred.
