Mira is employed as a purchasing clerk by Hartman Construction, a firm in Vancouver. She sends an offer by e-mail on behalf of her company to Gary, a supplier, to make an equipment purchase. Gary replied by e-mail two days later accepting the offer. However, during the interim, Mira quit her job at Hartman Construction. Her e-mail account was closed as a result of her leaving the company. Because the e-mail account was closed, Gary’s reply came back to him as undeliverable. After an immense effort over the course of several days, Gary was finally able to find out who replaced Mira. Once he was able make contact with her replacement, he was informed that the offer is no longer valid, as Chris, Mira’s replacement, had already found an alternate supplier. Was there an enforceable contract between Gary and Hartman Construction?

No, there is no enforceable contract between Gary and Hartman construction. The reasons are given below:

1. Meri had dropped a mail to Gary to make them understand on Hartman construction deals and there is no contract signed or agreed between both the companies.

2. Mira replacement Chris had found a different company and made the offer, so that act as legal and so the Hartman construction needs to continue with that. Because with Gary there is no any legal contract been approved.

3. Hartmam construction can choose any company for their deals and it is not necessary to go on with Mira options, as where the decision can be changed according to the companies opinion and options.
