Suppose you apply to be a Jimmy John’s delivery driver but find that the application includes a noncompete clause stating that you cannot work for any similar service (example Donimo’s) while working for Jimmy John’s and for 6 months after leaving Jimmy John’s. Is that legal? Explain.
Yes, if Jimmy John is providing full time employment to me as an employee then yes it legal to include the non compete clause in most of the states of USA except a few like California, Montana, North Dakota and Oklahoma. This is a very common clause and non only USA there are various other nations who allow this clause to maintain and keep the competitive nature of business valid. I believe if this clause is not present then it would be difficult for organization to main the competitive nature because everybody and anybody will be working for all the competitors which will actually disrupt the business environment.
