I think, if the patient merely nods her head instead of answering verbally is a clear indication that the patient is incapable of making medical decisions.An important thing that required to make medical decisions is capacity.
Capacity is the ability to use and understand information to make a medical decision and communicate any decision made.This patient is not giving  non verbal communication at all.I think this patient lack capacity because his or her mind is disturbed in some way and cannot make a decision at that time.
