Brad, who works as a nurse in the labor and delivery department of a hospital requests 10 weeks of unpaid vacation under the Family Medical Leave Act (FMLA) so that he can help take care of his wife and newborn baby girl. Upon requesting such leave, his supervisor tells Brad, “You have been pretty worthless lately anyway. I don’t know if it is because of your lack of sleep from taking care of that daughter of yours, or whether you just aren’t smart enough to handle the assignments given to you. I knew from the very time we hired you that you were too stupid to do this job….”

Brad is nervous about his job being secure while he is away on FMLA leave, but knows that it is necessary to take the time to care for his wife and baby girl. Besides, Brad was hoping the time away from work would keep creepy Connie from always rubbing his shoulders and telling him how handsome he was on a consistent basis --- which made Brad very uncomfortable and he did not welcome or appreciate.

When Brad returned from his 10 week FMLA leave, his supervisor told him that his position as a nurse in the labor and delivery department had been filled by another nurse, and Brad would now be working as a clerical assistant at the front desk—a job that paid much less than his job as a nurse did. Brad says, “that’s not fair…” but before he can finish his objection to the new assignment, his supervisor tells him, “you shouldn’t have left for so long… you can either work at the front desk job or you will be fired.”
