Cobbs had a stomach ulcer.Dr.Dubley Grant advised him for a surgery. He explained about the surgery but he didn't inform the risk of the surgery and it's needful treatment when he got his consent for surgery.So during surgery he has to remove his part of the stomach and spleen which was not explained to him.

It is the duty of the doctor to explain and the patient has the right to say no.It is considered to be negligence which made Cobbs to sue him on medical malpractice case. Dr Grant should have stood to the treatment which was consented by the patient will.
