M’s refusal of a heart transplant
M was a 15-year-old girl who refused to consent to a heart transplant operation in 1999 when her own heart was failing. Her mother gave legal consent on her behalf, but health professionals were unwilling to proceed without M’s agreement. M said she did not want to die but neither did she wish to have the transplant because this would make her feel different from other people.
‘I understand what a heart transplant means, procedure explained . . . checkups . . . tablets for the rest of your life. I feel depressed about that. I am only 15 and don’t want to take tablets for the rest of my life . . . I don’t want to die. It’s hard to take it all in . . . If I had children . . . I would not let them die . . . I don’t want to die, but I would rather die than have the transplant . . . I would feel different with someone else’s heart, that’s a good enough reason not to have a heart transplant, even if it saved my life. The case was heard in the High Court and decided what to be done.

1) According to my critical thinking the decision of the court in this situation would be to support the 15year girl because she herself is making the decision about her life and she is capable of it . She knows what the consequences will be if she do not go for heart transplant . Every individual has the fundamental right towards health and related decision .
2) The court was involved in medical decisions because the procedure can't be performed with out the assent and consent from filled by both patient and parent . So, to make the decision help from court was taken .
