From medical malpractice, to ethics, to medical records, there is a vast amount of legal knowledge to be aware of within the medical profession. Which of these do you feel is the most important that medical professionals should be aware of?

MEDICAL NEGLIGENCE

The medical profession is considered a noble profession because, it help in preserving life . We believe life is God given. A patient generally approaches a hospital , the expectation is that the doctors and hospitals are provide medical treatment with all the knowledge and skill at their command and secondly they will not do anything to harm the patient in any manner either because of their negligence , carelessness or reckless attitude of their staff. The negligence are,

- failure to follow standard of care

- failure to use equipment in a reasonable manner

- failure to communicate

- failure to document

- failure to assess and monitor

- failure to act as a patient advocate

So, the negligence is failure to take reasonable care or steps to prevent loss or injury to another person. Some possible sequence on the part of Health care professionals can include, worsening of the original condition, failure to treat the original condition and development of seperate condition.

Medical negligence is one if the serous issue in the country. Even the medical profession, which is known to be one of the noblest professions, is not immune to negligence which often results in the death of patient or complete or partial impairment or any other misery which has adverse effects on the patient's health.

Patient has to try and prove the health workers fault .in a patient alleges malpractice in medical field, the law will acquire a high standard of evidence available in medical science presented with expert openion is required by the complainant to prove negligence byvtge doctor or health worker. The complant must prove the allegation against the doctor by citing the best evidence available in medical science and presenting expert openion. Indian penal code 1860 sections 52,80,83,88,90,91,92 304-A,337 and 338 contain the law of medical malpractice in india.
