The 1938 Amendment to the FTC ACT shifted its focus from a strict liability provision to one based on fault. TRUE or FALSE

Homework Answers

Answer #1

Answer: false

The act was passed in the year 1914 in order to protect unfair practices in trade like faulty advertisement, illegal competition, etc.

It was amended in the year 1938 by changing the focus from antitrust act to consumer protection act. This is the way of giving more protection to the consumers by enforcing strict liability on products – if a product creates damage intentionally or unintentionally, the producer would be held responsible in anyway.

Therefore, the strict liability is not removed through this amendment.
