In the context of the housing sale or rentals, under what specific circumstance may one discriminate against members of a "protected class" in seeming violation of Title VII of the Civil Right? In your opinion, should this exception be abrogated and why.
In the context of the housing sale or rentals, the specific circumstance under which one may discriminate against members of a "protected class" in seeming violation of Title VII of the Civil Right is under the context of The Fair Housing Act. The Fair Housing Act is for owner-occupants living in a unit of a residential building serving four or fewer households, including single-family home. By exemption to this law, owners of such units may discriminate on the prohibited bases, provided they do not employ the service of a broker or agent.
In my opinion, this exception should not be abrogated because as an owner-occupant they should be allowed to decide who their neighbors are.
