Ethel was having a new pool installed in her back yard. At day’s end, the workers left their tools and supplies in the yard to be used the following day. There was no fence put up around the area. That night, Ethel’s neighbor’s daughter, Lucy, a girl of 8, decided to investigate all of the interesting things the workers had left in the yard. While looking around she fell into the big hole where the pool would go and she suffered severe injury. The next night, Fred, Ethel’s adult neighbor, and father of Lucy, also decided to investigate the work and he, too, fell into the hole, suffering severe injury. Lawsuits were brought by both Fred and Lucy against Ethel. Ethel said that they were both trespassers and she has not liability for their injuries. Who will win and why?

Above mention matter is related to Law of Tort,Law of tort explain that if any person harm privacy of any person it is wrongful act, As we know that wrongful act  of a person over others property and body results in many harms either public or private.For saving common people to face such type of problem word tresspass is defined. the term trespass is an act intentionally make interference in one's property or in person life,here intentionally means any wrongful act done voluntarily.

In the given case Lucy and Fred enter into the area of mr Ethel which is according to law of tort is trespassing ,so here Ethel is right and she has no liablity for the injury of both becuse both entred other parties property voluntarily is considered as wrongful interference of one over the property of another without any valid reason.
