  1. Mr. Imran was working in Trinity Software LLC in Muscat as a Computer Programmer. His service record shows that he worked in the company from 7th December 2008 till 7th December 2016. At the beginning of his career he was getting a Basic salary and Gross salary of 600 pm and 1000 pm respectively. At the time of leaving the job, his both salaries increased by 20%. After careful examination of Mr.Imran’s service record, Company’s accountant identified that there is a service break. Accountant noticed that there was an unapproved break of exact one year in the service of Mr.Imran after exactly four years from the start of his career with Trinity Software.

According to my view Mr Imran will not get any gratuity amount from Trinity Software LLC.

Eligibility for getting gratuity is employee has to provide contionuous service of minimum 5 years to the organisation, hence in this scenario Mr Imran has discontinued for 1year after exactly 4 years of continuous service out of total period of service 8years.

Since Mr Imran has not provided 5 years of continuous service in Trinity Software LLC , he is not eligible for any Gratuity amount.
