A writer prints false stories about the local mayor and accuses him of false accusations of corruption. The mayor decides to press charges on the writer for libel. The writer claims he has freedom to write whatever he wants in the paper because of the first amendment. How would the Supreme Court rule on this case? Would the Supreme Court side with the Mayor or the writer and why?
There is freedom to write anything but it does not mean that dignity of others is tarnished under the guise of freedom of the press. The right to live the life with dignity is most sacred right or fundamental right. The one individual can not infringe upon the rights of others.
Here, the Libel which is pressed against the writer would be uphold by the supreme court as well. The writer would have to pay the huge amount as reparation towards the damages to the honour and dignity of mayor.
