Answer #1

In this case the Employee(joe) has certain rights after his termination, which has to be fulfilled by the employer. The non-fuulfilment of such rights empower the employee to claim his right by suing the employer in the court of law. While terminating an employee, the employer needs to comply with federal and state law because these laws supersede contract provisions.

Employers may not fire even at-will employees for illegal reasons. In this case, Joe is sucessful and outstanding employee in 20 years. but he is terminated on the basis of age, so he shouldtalk to a lawyer right away. There are strict time limits and rules that apply to discrimination claims; for example joe must file a complaint of discrimination with a state or federal agency before sue the employer in court. For more information on these type of claims, see Wrongful Termination:Discrimination and harassment.
