Explain what the Robinson-Patman Act prohibits, what is required to show a violation, and what the defenses are.

Homework Answers

Answer #1

Robinson-Patman Act is an act which prohibits the sales which make discrimination in price on selling goods to equally situated distributors. The effect of such sale is mainly to reduce or decrease competition and it might give favored customers an advantage or priviledge in the market which is not related to the actual efficiency. This act is considered to violate antitrust laws which cause injury to propery or business.

The defences of this act are:

  • The concession on price was given as a good faith in order to meet competitor's price.
  • The difference in price is justified by multiple costs in sale, manufacture or delivery.
