A bonafide occupational qualification is a particular type of job qualification which if fulfilled would not be called discrimination in the basis of race, sex, caste or creed. But would be rendered discriminatory if it were not necessary to perform the job in question. To determine whether the policy in hiring is not discriminatory, the policy is cross checked with the guidelines to determine whether the discrimination is necessary or not to continue with the normal business.

A restroom attendant could be hired on the basis of sex and not follow consequences for a discriminatory hiring because the users of restroom have privacy rights.
