The U.S trade representative has determined that the acts, policies and practices of china related to technology transfer, intellectual property and innovation covered in the investigation arre unreasonable or discrimanatory and burden or restrict U.S commerce. Section 301 U.S trade representatives initiated an investigation into certain practises of Government of China and the notice comments on four categories:

1. The Chinese Government reportedly uses a variety of tools including opaque and discreationary administrative approval process, joint venture requirement, foreign equity limitations, procurement to intervene in U.S companies operation in china to pressure technology transfers.

2. The Chinese Government acts, policy and practices reportedly deprive U.S companies of the ability to set market based terms in licensing and other technology related negotiations with Chinese companies and undermine U.S companies control over their technology in China.

3. The Chinese Government reportedly directs the unfairly investment in acquisition of U.S companies asset by Chinese company to obtain cutting edge technologies and intellectual property and generate large scale technology transfer in iindustries deemed important by Chinese government industrial plans.

4. The investigation will consider whether the Chinese government is conducting or supporting unauthorised intrusions into U.S commercial computer networks or cyber enabled theft of intellectual property or trade secret or confidential business information and whether this conduct harms U.S companies or provides competitive advantages to chinese companies or commercial sector.

The committee set under section 301 report supports the findings that each of the four categories are discriminatory and restrict U.S commerce.
