The Supreme Court odered a retrial because the contract between National Thermal Corp and Singer was governed by Indian Laws. Since the contract was governed by Indian Law, Singer cannot sought to enforce the award by ICC tribunal under the Foreign Awards Act. Therefore, despite the contract’s clear submission to ICC arbitration, the whole case had to be retried in India under the Indian Arbitration Act.
