There are several landmark court cases that have dealt with the issues concerning this topic and it is very appropriate to discuss the precedence that has been set regarding this topic.

The whole idea here is the encroachment of peoples rights. If people are being approached on the streets of the city by the police then they must be read the miranda rights and informed that they have the right to an attorney and defend themselves in a court of law. The 4th ammendment protects the rights of individuals and prevents unlawful searches and arrests. A clear warrant for a search or an arrest must be there in place before a search is carried out and also an arrest is made. If this is not the case then the evidence obtained from the search or the arrest made can be thrown out in a court of law. The 4th ammendment must be protected in all respects.
