For economic strikers, must the company reinstate, with back pay, those who return for work?
yes
no
Yes.
According to the Laid Law doctrine and the Reinstatement right of the workers by the Board of National Labour relation Act, it has been clarified and firmly stated that the employer-company has to reinstate the workers, with back pay, who willingly return to work after calling off the strike.
However,it should also be mentioned that the employers can manage to escape this if they can show legitimate reason of refusal or the unfair business-grounds and consequences of the strike.
