Punishment is the deliberate infliction on another person of pain or other unpleasant consequences. To be called a criminal punishment, the sentence must have the following four criteria; it must have been intended to inflict pain or other adverse effect, to enforce a punishment in the same statute as the offense, and it must have been carried out by the government. Criminal punishment "merit" behaviors are complex and vary depending on our current and historical norms and morals. Murder and rape would be known as offenses or actions deserving of criminal punishment. Some others would be violent crimes of hate, terrorism, and domestic abuse. For example, a violent hate crime is done voluntarily. The act is meant to hurt the individual's death and is typically intentional based on their personal beliefs.

Deterrence by intimidating the accused or the public prevents future crime. General and general deterrence are the two forms of deterrence. An individual defendant is entitled to clear deterrence. When the government punishes an individual defendant, theoretically, due to fear of another similar or worse punishment, he or she is less likely to commit another crime. Specific dissuasion refers to the general public. When the public knows about the punishment of a particular criminal, the public is potentially less likely to commit a crime due to fear of the prosecution's penalty.
