It is the US president, that appoints the supreme court justice that is confirmed by the Senate of the USA. At present, the majority goes to republican party in the senate that is to be maintained when Joe Biden is to be elected as president. It means that President Joe Biden cannot appoint a candidate that is not confirmed by the senate. Hence, he has to be very careful in selecting the candidate for supreme court justice position that is supported by both Republicans and Democrats to get confirmed. Then only, the candidate will work as supreme court justice. So, the president has to be careful as in the past, 37 nominations have been already unsuccessful when candidates were nominated by the president.
