Conditions required for a tort
Tort refers to an act which is in violation of the civil law and leads to injury or harm to someone.
Following conditions are required for tort -
1. There must be duty - This duty implies all reasonable precautions that should be undertaken while performing an act so as not to inflict damages or injury on someone else.
2. There must be a breach of duty - The duty as stated above is not adhered to. This implies that a person conducting act has not taken all the reasonable precautions.
3. There must be damage or injury caused by the breach of duty - Lack of reasonable precautions being taken by the person performing the act has resulted in damage or injury to someone else.
When all the above conditions are satisfied then tort is said to have taken place and could result in the grant of financial compensation to the injured party.
