The forty second amendment is the amendment that relates directly to the powers / jurisdiction of the supreme court. It was implemented in 1976 and is also known as mini constitution. It is one of the important amendment as it tries to lowers the power of supreme and high courts. The main terms or statements included in this amendment are :

  • Fundamental duties by the citizens were introduced.
  • Made the president bound by the advise of the cabinet.
  • Made the constitutional amendments beyond the judicial scrutiny.
  • It also curtailed the powers of judicial review of the supreme courts and the high courts.
  • It also provided that the laws made for the implementation of directive principles cannot be declared invalid by the supreme courts or high courts on the ground of violation of some fundamental laws.
