The engineer has approved the master schedule of the general contractor which reflects a completion date 10 weeks before the stipulated date in the contract. Shall the engineer plan towards this early completion date? Explain.
Most sacrosanct document between Contractor and Owner(Engineer) is the contract document signed by both parties at the time of awarding the contract. This contract document and all its clauses etc are binding on both the parties . This includes the very important clause of Stipulated Date of completion of the project.
So though the master schedule of general contractor reflecting completion date 10 weeks before stipulated date in contract is approved by the engineer , still the contractor can complete work by stipulated date by stating reasons for extension .So the engineer while planning for early completion date must keep the stipulated date in mind as that is the contractually binding date.
