the first operon has constitutive active lac operon but this lac operon cannot express beta-galactosidase because lac Z gene is mutated, in the second operon the regulatory components, lac I, lac P, lac O are functional if lactose is present, it inhibits the lac repressor encoded by lac I gene so lac repressor cannot bind to the lac O, lac operator, so this lac operon is expressed if lactose is present, this operon has functional beta-galactosidase so beta-Gal activity is seen in the presence of lactose.
