Individuals who fail to maintain minimal essential health insurance coverage are subject to the individual shared responsibility payment. Accordingly, taxpayers are currently required to be in compliance with the individual mandate provision or be subject to the individual shared responsibility payment.

Beginning in 2019, there will be no individual shared responsibility payment due if an individual fails to maintain minimum essential coverage. For 2019 and beyond the penalty will no longer be assessed.

Starting with the 2019 plan year (for which you’ll file taxes in April 2020), the Individual Shared Responsibility Payment no longer applies.
