Who would you consider to be most at risk legally, the principal or the agent?

Homework Answers

Answer #1

Guided by contract of agency.

Strictly speaking, as per law principal can be considered as riskier than agent.

But times and situations may arise where agent will be liable for the acts done by him which are beyond on his power that is in such a case agent is having more risk.

Any act done by the agent is considered as if it is approved or done by principal itself.

But of course agent is having limited power within which we can act in accordance with the restrictions for agreement between himself and principal.
