Here I think Bob does know that what he is doing is wrong as it is mentioned that he is well aware of the memo and that memo doesn't say anything about employee or intern. No matter if he believe it is not wrong or he have any doubt it would have been better if he get it clarified by an senior person.
It matters as in certain situations although the amount may not be high but it can be considered as fraud.
