To be considered as a primary government, there are three criteria that must be satisfied by the unit:

-- It should have a separately elected governing body.

-- It has to be fiscally independent of other local and state governments.

-- It should be independent legally that can be demonstrated by having powers of corporate such as the right to be sued and sue in its own name along with the right to sell, buy, and lease the property in its own name.
