yes. US company knew or should have known of Bolivian law. ergo, they are responsible for their agent's fiscal loss.

That would depend on what was in the contract between MacDonald & the manufacturer, but, if the country has that personal guarantee as commonly-known law, MacDonald should have had some recourse built-into his contract with the manufacturer.
