Question: There could be more than one offer in a scenario and therefore, more than one offeror and offeree. In those instances, be specific about which party is the offeror and offeree with each specific offer.

Answer The Scenarios Below:

  1. Sarah: I will sell you my purse for $100. Sheila: Let me think about it. Sarah: Never mind, I already sold it.
  2. Flo: I will sell you my computer for $200. Dale: No way! I am not interested in your computer – it has been repaired 100 times!
  3. Megan: I will sell you my concert ticket for $100. Sasha: No, I don’t want it for $100. Sasha: But I’ll give you $25 for it. Megan: No way it is worth four times that much! Sasha: I really want to go to the concert so I’ll give you $100 for the ticket.
  4. Randy: I really don’t like my new apple watch, so I will sell it to you for $250. I have only worn it three times. Chuck: I wish I had an extra $250, but I don’t – I had to have my car repaired. Jim: Make it $150. Roger: Ok, it’s a deal!
  5. On Monday, Teddy makes an offer to sell his car for $1,000 to both George and Charlie. Teddy tells George and Charlie the acceptance must be in writing. George accepts the offer in writing and places the offer in the mailbox on Tuesday morning. Charlie meets Teddy on Wednesday for lunch and gives Teddy a written document accepting the offer to purchase the car for $1,000. On Thursday, Teddy receives George's acceptance in the mail. Who is the offeror and offeree? Is there an enforceable contract? With whom? Why?

Answer #1

Answer:-

The party making an offer is called as offeror and the party to whom an offer is made is called as offeree.

1.In this case,Sarah is making an offer and hence she is an offeror and Shiela is the person to whom offer is made hence she is an offeree.

2.In this case Flo is the offeror and Dale is offeree.

3.In this case,Megan is the offeror and Sasha is offeree.

4.In this case,Randy is offeror and Chuck is offeree.

5.In this case,Roger is offeror and Jim is offeree.

6.In this case,Teddy is an offeror and George and Charlie are offerees. This is a contract since it contains all elements i.e,offer, consideration, acceptance, legally enforceable and mutuality. It is an enforceable contract with George since he accepted the offer on Tuesday by mailing.Mailing rule is an exception to the general rule of acceptance since the same is considered to be effective when the acceptance is mailed.
