The contract is a binding agreement of two or more parties that involves the duty, breach, and damage of both the parties. The parties are assigned their duties in the agreement and they would be liable for any breach of duty or damages that occurred due to the negligence.
The person who has filed the complaint is the plaintiff whereas, the person against whom the complaint is filed is the defendant.
The defendant would only be liable for the damages which have occurred due to his negligence. He would not be liable for any act for which the plaintiff was responsible.
