Administrator is a companies agent who have general power to do
things which is necessary or expedient for the management of the
companies business and property. An administrator enjoys the same
power as that of company or its directors.
Roles and power of the administrator:
- An administrator performs functions that are directed by the
tribunal.
- He has a power to remove the director of the company or to
appoint new director.
- He has a power to call meeting of the members or the creditors
of the company.
- An administrator can request for the supply of gas,
telecommunication services, etc during the time of
administration.
- He has power to inquire about the company dealings.
- He can apply to court regarding an order to set aside
transactions that are made to defraud creditors.
