Agency contracts can be express or Implied, (i.e oral or written) and are created by the consent of both the parties(i.e Principal and Agent).
The principles of agency relationship are universal in nature and hence doesn't change according to countries.
Therefore it can be concluded that, Agency relationship in New York will be valid only if it is established in writing is incorrect.
But generally most of the contracts or any contract will be enforceable if it is in writing, and can be produced as an evidence if any party to the contract commits default or breach in discharging their obligations.
