Other than the mandate Internal Revenue Code and few other reporting norms, benefit programs are largely unregulated by the federal government. The employee benefits security administration(EBSA) covers most provate estabilishment. There is no government mandate stipulating the employer to setup any plan with respect to employee benefits. The role of the government only comes up when the plans are voluntarily setup by the organisation under the employee retirement income security act(ERISA).

Hence, in my opinion there's too little government intrevention to mandate organisations from setting up an progrm for employee benefits and too much intrevention after the programs are in place by the organisation.
