Defendant is the person aganist whom a case is filed, or in other words, he is the person acused of committing a breach of contract. In a landlord-tenant case, the plaintiff, i.e the person bringing up the case is called the petitioner and the person accused of breaching a contract, i.e the defendent is called the respondent. This is because he/she who is accused of breaching the contract is responding to claims of the plantiff, and hence he is called the respondent.
