If a person dies suddenly, who is responsible for their debts?
Asked By Cadence O,Last Answer By ashimagupta02 At 08.13,8 Answers

Unless you live in a community property state, debt is not inheritable. Some community property states, your spouse can be held responsible.

Your estate is responsible for your debts; no one can inherit anything until the debts are all paid.

Life insurance procedes, well, it depends on who is being paid. If you pay someone directly, the money goes to them. If it pays your estate, then the money goes to pay off your debts, then anything left over after the debts are paid, can go to your heirs.

Having a discussion at work, who is responsible for a parents outstanding bills when parent dies?

Next of kin, since the average Joe doesn't have an "estate".... When a friend of mine's ex husband died his next of kin was responsible. I know, cause they tried to get her to agree to be "next of kin" so they could pin his debts on her. Although, I wouldn't be surprised if this varies from state to state!

Where can my husband get debt consolidation to pay off credit card debts without collateral?
Asked By NoNo,Last Answer By stopccdebt At 2009.12,1 Answers

We went to apply at a credit union and the first time the lady said that we was approved of the amount that we asked for without collateral and that the next day we could fill out the forms and get our loan. The next day we went, it was a totally different woman and story. She told use that we was not approved at all for the amount of the loan that we have asked for but that they colud offer us another amount in which was not enough to pay off one of the four credit cards that we have. It's very, very fraustrating because we pay all our bills on time and we do make the mininmum payments on the credit cards which ranges from $50-$100 but that's not enough for them. We just want to pay off the credit cards and to build our credit back up again. What can we do? We need some help!!!

When a parent dies in your family and they have left some bills like credit cards is the family responsible?
Asked By JBWPLGCSE,Last Answer By New Boots. At 2009.12,1 Answers

Can those bills then be put on your credit record from the deceased family member? Can the family lose what they have due to what the relative left behind? What if they don't have the money to pay it back? I know if it's your husband or wife then your automatically responsible, but if it's one of your parents what happens?

'CANCEL CREDIT CARDS PRIOR TO DEATH !

Be sure and cancel your credit cards before you die! This is so priceless .

A lady died this past January, and Natwest bank billed her for February
and March for their annual service charges on her credit card, and then
added late fees and interest on the monthly charge. The balance had been
R0.00, is now R60.00. A family member placed a call to the Natwest Bank
call centre:

Family Member:
'I am calling to tell you that she died in January.'

Natwest
'The account was never closed and the late fees and charges still apply.'

Family Member:
'Maybe, you should turn it over to collections.'

Natwest
'Since it is two months past due, it already has been.'

Family Member:
So, what will they do when they find out she is dead?'

Natwest
'Either report her account to the frauds division or report her to The
credit bureau, maybe both!'

Family Member:
'Do you think God will be mad at her?'

Natwest
'Excuse me?'

Family Member: 'Did you just get what I was telling you . . . The part
about her Being dead?'

Natwest
'Sir, you'll have to speak to my supervisor.'

Supervisor gets on the phone:
Family Member:
'I'm calling to tell you, she died in January.'

Natwest
'The account was never closed and the late fees and charges still apply.'

Family Member:
'You mean you want to collect from her estate?'

Natwest
(Stammer) 'Are you her lawyer?'

Family Member:
'No, I'm her great nephew.' (Lawyer info given)

Natwest
'Could you fax us a certificate of death?'

Family Member:
'Sure.' ( fax number is given )
After they get the fax:
Natwest
'Our system just isn't set up for death. I don't know what more I can do
to help.'

Family Member:
'Well, if you figure it out, great! If not, you could just keep billing
her. I don't think she will care.'

Natwest
'Well, the late fees and charges do still apply.'

Family Member:
'Would you like her new billing address?'

Natwest
'That might help.'
