It seems rather silly. Last I checked, a US patent lasts for 21 years while a trademark lasts for 99!! Why? It just leads to rent-seeking behaviour by patent-holders. I would argue that innovation includes business development as well, not just product development and then charging others royalties.

I would suggest a value-based system. Instead of treating all products the same way, why not allow them to determine their own 'reward for innovation'. The first thing one needs to understand about patents is they're NOT natural private property. They are, more accurately, a state granted monopoly. How do I say this? Well, since when has ownership of property had a time limit? That's called leasing, not outright ownership. And if we were to allow all patents to become natural ownership, then they'd never run out and we'd cripple the economy due to monopolies on every patent ever filed from safety pins to generic drugs. So they can't be considered ownership, just a leased monopoly.

So what would a value-based system look like? Well, simply put, the govt. determines a set value or 'fair reward' for all patents accepted in all product categories. It will be a percentage of the products development costs of profits after recovery of the development costs themselves from sales. So say it is 100%. Then the patent holder can use the patent to recover all his development costs with the advantage of a monopoly and then go on to make that same amount as profits after the initial recovery as reward for his efforts and creativity. After that, the patent lapses and we allow free competition leading to maximum consumer welfare.

The advantage of this system is that it's adaptive. Since it's a percentage, those products that sell slowly and make little money will have their patent last longer while those that sell like hot cakes will lapse and be open to competition much sooner. This would especially be a boon in fields like pharmaceuticals and will serve to drastically improve conditions for the worlds poor.

The thing to remember is that while innovation may need incentives(though not neccesarily monetary incentives), a free market hates monopolies. Monopolies only serve to make a free market less free. That's why there are those who wish to abolish patents altogether. The debate about that extreme step rages on, but for the time being, this seems a far more sensible process in the interim.

And I don't for a moment subscribe to some Randian nonsense of the primacy of creativity. A product incurs some costs to develop. And under this sytem, the patent holder gets to reap a fair reward for his efforts after recovering all his monetary expenses as well. So there is a reward for his efforts. What it helps to avoid is blatant misuse of patents to invent something and then reap the rewards at everyone else's expense(since the consumers ultimately pay the royalty) for the rest of your days. It creates a more even playing field. And it allows the market to determine the value of the patent, not the govt. with its rather ridiculous timed approach.

It seems odd that these southern-fried evangelists -historically antijewish - should have abruptly become passionate zionists just as U.S. aid to the izzies dramatically escalated after Dallas.
